- An individual under the legal drinking age may be on the licensed premises of an on-sale retailer under the conditions established in A.R.S. § 4-244(22).
- Additionally, an individual under the legal drinking age may be on the licensed premises of an on-sale retailer if:
- The licensed premises have an occupancy limit of at least 1,000 as determined by the fire marshal;
- The primary purpose of the licensed premises is not to sell spirituous liquor but rather, to show live sporting events or concerts;
- The on-sale retailer ensures that spirituous liquor is sold only to individuals who are of the legal drinking age; and
- The on-sale retailer implements security measures necessary to ensure that an individual under the legal drinking age does not purchase, possess, or consume spirituous liquor on the licensed premises.
- Additionally, an individual under the legal drinking age may be on the licensed premises of an on-sale retailer if:
- The licensed premises have an occupancy limit less than 1,000 as determined by the fire marshal;
- The primary purpose of the licensed premises is not to sell spirituous liquor but rather, to show live sporting events or concerts; and
- The on-sale retailer establishes a physical barrier that prevents an underage individual from:
- Entering a portion of the licensed premises where spirituous liquor is sold, possessed, or served; and
- Receiving, purchasing, possessing, or consuming spirituous liquor in that portion of the licensed premises.
- This Section is authorized by A.R.S. § 4-210(M) and 4-244(22).
